San Bernardino City Council members on Monday rejected a bid to subpoena city staff for hearings on oversight, funding and child-protection measures in Mayor Pat Morris' crime-fighting Operation Phoenix.
Council members voted 5-2 in closed session, with Esther Estrada and Wendy McCammack dissenting, against issuing any summonses to testify.
"(Subpoenas) are premature," Councilman Neil Derry said. "The administrative hearings are still ongoing and we'll have opportunities to ask further questions of the police chief and other department heads if we want to. Then, if we don't get our answers, subpoenas are an option."
Councilmen Rikke Van Johnson and Tobin Brinker also said they're not yet ready to demand sworn testimony regarding the program, which was shaken last month by the arrest of Michael Steven Miller, 48, a supervisor at one of the Phoenix community centers
